The commercial warranty is in accordance with the warranty certificate issued by the manufacturer, depending on the product category. This represents the period during which the consumer benefits from free repairs from the seller/manufacturer.
All products benefit, by law, from a compliance warranty, which represents the legal period of up to 2 years during which the consumer is provided with a compliant product free of charge. Compliance refers to the characteristics of the product offered to the consumer through the related advertising made by the seller/manufacturer.
Within the compliance warranty period, the manufacturer will repair, replace, or refund the value of the product, in accordance with Ordinance no. 9/2016 amending and completing OUG no. 140/28/12/2021 regarding the sale of products and associated warranties. Any repair or replacement of products will be made within a time period agreed upon in writing between the seller and the consumer, taking into account the nature of the products and the purpose for which they were requested.
The agreed-upon time period cannot exceed 14 calendar days from the date the buyer has informed the seller of the non-compliance of the product or has handed the product over to the seller or a person designated by them based on a handover document.
According to OG 21/1992, the seller is obliged to provide the consumer with:
For products whose average service life is less than 2 years, the warranty period is reduced to this duration.
For toys, the average service life is 3 months, excluding electric and electronic toys which have an average service life of 12 months.
Everyday use products (for example, plastic toys, wooden toys, plush toys, play dough, etc.) do not benefit from a commercial use warranty.
Children's strollers, car seats, high chairs, tricycles, scooters, and battery-operated cars have an average service life of 2 years.
The warranty for batteries in battery-operated cars is 3 months, taking into account how the product has been used and charged.
The right to warranty is lost in the following cases:
Scratches constitute normal wear and tear and do not represent grounds for warranty claims. Wear on stroller or tricycle wheels is also considered normal wear and tear.
Extended exposure to sunlight, sweat, or frequent washing of the material may lead to discoloration and is considered normal wear and tear, not grounds for warranty claims.
