Commercial Warranty
The commercial warranty is subject to the warranty certificate issued by the manufacturer, depending on the product category. It is the period during which the consumer is entitled to free repairs from the seller/manufacturer.
Conformity Guarantee
By law, all products are covered by a conformity guarantee, which is the statutory period of up to 2 years during which the product is brought into conformity free of charge for the consumer. Conformity refers to the product features offered to the consumer through advertising by the seller/manufacturer.
During the conformity guarantee period, the manufacturer will repair or replace the product, or refund its purchase price, in accordance with Order No. 9/2016 amending and supplementing Government Emergency Ordinance No. 140/28/12/2021 on the sale of products and associated guarantees. Any repair or replacement of products will be completed within a period agreed in writing by the seller and consumer, taking into account the nature of the products and the purpose for which they were requested.
The agreed period may not exceed 14 calendar days from the date on which the buyer notified the seller of the product’s lack of conformity or handed the product over to the seller or a person designated by the seller, under a handover document.
Under Government Ordinance 21/1992, the seller must provide the consumer with:
- a warranty certificate (only for durable goods)
- an instruction/user manual.
For products with an average service life of less than 2 years, the warranty period is reduced to that service life. Toys have an average service life of 3 months, except for electric and electronic toys, which have an average service life of 12 months.
Toy Warranty
Everyday-use products (for example, plastic toys, wooden toys, plush toys, modeling clay, etc.) are not covered by a commercial warranty. Strollers, car seats, high chairs, tricycles, scooters, and battery-powered cars have an average service life of 2 years. The warranty on batteries for battery-powered cars is 3 months, depending on how the product has been used and charged.
Right to Warranty Coverage
Warranty coverage is void in the following cases:
- The buyer has not followed the transport, use, maintenance, or installation instructions specified in the user manual.
- The product has been stored in unsuitable conditions, exposed to the elements, or handled improperly.
- The product has been modified or repaired by anyone other than an authorized person.
- The warranty does not cover normal wear and tear.
Scratches constitute normal wear and tear and are not grounds for a warranty claim. Wear on stroller or tricycle wheels is also considered normal wear and tear. Prolonged exposure to sunlight or perspiration, or frequent washing of the fabric, may cause fading and is considered normal wear and tear, and is not grounds for a warranty claim.
